Banks over the CRE line. 264 US banks hold $283 billion of commercial real estate above 300 % of capital.

Regulators have a rule of thumb for when a bank has too much of its capital in commercial property: three times. We counted the mid-size banks, 100 to 999 employees, that are past it. One in five is. They are mostly small teams holding very large books.

The argument in one paragraph

The line is a reason for a second look, not a verdict. mid-size banks are over it, and of them hold or more of investor property loans on teams of a few hundred people. The risk is concentrated in a few states and in the larger banks, so the second look has to be done loan by loan, not portfolio by portfolio.

Part 1 · The line

One mid-size bank in five is over three times capital.

In December 2006 the US bank regulators wrote down when a bank should expect a closer look. One trigger is of capital in commercial real estate loans. It is not a limit and it does not mean a bank is in trouble. It means the examiner will ask how the bank manages the concentration.

We took the US banks with to employees, the banks big enough to lend on real estate at scale and small enough to have no analyst department, and measured investor property loans against capital in their June 2026 reports. are at or more, of the group. Together they hold of investor property loans, out of held by all .

Investor property here means construction and land loans, apartment buildings, and commercial buildings not occupied by their owner. The typical bank over the line is at . The groups below show that most sit close to the line, and a few are far past it.

Just over the line. 119 banks, the largest group, hold $109.1 billion between them.

The middle of the range matters most for the money. sit between and , and they hold , of the total. The tail is small in count and large in dollars: at five times capital hold .

One caution on the measure. The regulators’ ratio divides by total risk-based capital and ours divides by equity, which is the figure on every report, so ours runs higher for some banks. The regulators’ test also looks at how fast the book grew over three years, which we did not measure. Read the as the banks to look at first, not as a list of banks the regulators have flagged.

The count is national. The risk is local: it sits in the states with the most property and the most banks.

Part 2 · The map

Three states hold 30 % of the dollars. New Jersey has the highest share of banks over the line.

The banks are in at least states and Guam. hold of the that sit in states we can place on the map, . Texas has the most banks over the line, , and the most mid-size banks of any state, .

The share tells a different story from the count. In New Jersey mid-size banks, , are over the line, and their books are large: . In California it is . In Texas it is about one in four.

11 banks, $28.3 billion

11 of 20 mid-size banks headquartered here are over the line, 55 %. The typical one holds investor property loans at 433 % of its capital.

One bank in Guam ($0.8 billion) has no tile, and six banks have no state on file; the map shows 257 of the 264. Banks are counted in the state of their head office, not of their loans.

A state tells you where the banks are. It does not tell you how big they are, and that is what decides how a bank can check its own loans.

Part 3 · The size

Half of the banks over the line have fewer than 250 people, and 88 of them hold more than $1 billion.

Each dot below is one bank over the line. Across is investor property loans, from to on a log scale. Up is the concentration. Most dots sit in the lower left: a bank of a few hundred people at to .

The top right is the group that matters most. hold or more of investor property loans, and together , of the . The other end is under , in all.

Pick a staff band to see what a typical bank in it looks like. A bank in the to band has a median book of . A bank with to staff has . Both have the same concentration, near . The smaller one has far fewer people to review the loans.

264 of 1192 banks in this band are over the line. The median one holds $736 million of investor property loans at 355 % of equity.

Banks are not named. Investor CRE is construction and land, apartment, and non-owner-occupied commercial property loans; concentration is that total over equity, 30 June 2026.

This is why the line is hard to work with from the inside. A bank over three times capital has to show it reviews its loans on the property’s numbers: rent roll, operating statement, appraisal, the borrower’s plan. At people there is no team that does this for several hundred loans a year. The second look is the work that does not get done.

What to do with this

If you run credit at a bank over the line: the useful question is not how many loans exceed a ratio but which ones carry the risk. That needs every file read against the property’s own numbers, on the new loans and on the renewals.

Titleman reads the credit file of a commercial property loan, the offering memorandum, rent roll, operating statement and collateral, and returns the issues and the questions for the borrower. The review covers every loan put in front of it, so the second look is the same for the 200th loan as for the first.
